After pondering and hearing both sides regarding Sogie Bill, hear are my points why I ' am against this Bill, you may have see me debating from the point of View of the Pro and at the same time from the point of view of the Anti Because It is STUPID and DUMB that you make a hasty decisions WITHOUT knowing the issues of both Parties.

Sa "Section 4. Discriminatory practices - It shall be unlawful for any person, natural or juridical, to engage in discrimination as defined in this Act, which shall include;
a) Denying access to public services, including military service, to any person on the basis of Sexual orientation or gender Identity or expression. "
This passage is irrelevant why? You do remember that the military has express that even Gays are welcome to enter the military. So why Pass this particular paragraph?
"b) Including sexual orientation or gender identity or expression, as well as the disclosure of sexual orientation, in the criteria for hiring, promotion, transfer, designation, work assignment, re-assignment, dismissal of workers, and other human resource and movement action, performance review, and in determination of employee compensation, access to career development opportunities, training and other learning and development, interventions, incentives, privileges, benefits and allowances and other concerned or other terms of conditions of employment. Provided that this provision shall apply to employment and skills training in both private or public services including, military, police, and other similar services. Provided, further that this prohibition shall apply to contracting and engaging of the services of juridical person"
Again this paragraph is non-sense. Get the state OUT OF RECRUITMENT OF WORKERS! I believe that it is within the prerogative of the companies to recruit whoever they want. According to some socialist " Capitalist knows one thing only and that is MONEY" So if they pick a wrong person how can they earn with a good profit? and besides there are many cross - dressers, gays, transgender that are well paid by the companies specially in the BPO industry Gays are known for there slung accent when they talk in english, gays are also known to be entertainers like Vice ganda etc. SO IF YOU IMPRESS YOUR CAPITALIST BOSS THEN WHY ARE THEY GOING TO FIRE YOU?
c) Refusing admission or expelling a person from any educational or training institution on the basis of sexual orientation or gender identity or expression, Including discriminating against a student or trainee due to the sexual orientation or Gender Identity or expression of the students parents or guardian; Provided, However, that the right of educational and training institutions to determine the academic qualification of there students or trainees Parents shall be upheld
This is what the churches, and other sects are concerned about. You see there are many catholic schools here in the Philippines. Now how can they practice what they are teaching if the state will intervene with the church's teachings? it is a complete violation of the separation of church and state. Unang una Hindi naman pera ng gobyerno ang ginastos sa pagpapagawa ng mga Katolikong Eskwelahan at sino ka para magdikta kung sino ang mga dapat papasukin. Kung gusto mo mag aral dun bkit hindi mo sundin ang mga palatuntunan ng Eskwelahan? Kung hindi mo gusto sa PATAKARAN NG ESKWELAHAN NA IYON EDI LIPAT KA SA IBA!.
d) Imposing disciplinary actions, penalties higher than customary or similar punishments or requirements, restrictions, or prohibitions that infringe on the rights of the students on the basis of sexual orientation or gender identity or expression, including against discriminating against a student or trainee due to the sexual orientation, or gender identity or expression, of the students parents or guardian.
Pero kailangan pa ba ng particular na paragraph na ito? We all know that we already have a law regarding on bullying and that is the Republic Act.10627 An act requiring all elementary and secondary schools to adopt policies to prevent and address the acts of bullying in their institutions. with this law is there a need for this bill to pass?
e) Refusing or revoking accreditation, formal recognition, registration or plan to organize of any organization, group, political party, institution or establishment in any educational institutions, workplaces, communities, and other settings, solely on the basis of the sexual orientation or gender identity, or expression of there members or of their target constituencies.
Well this has already been granted by the law. One example it are the labor unions that represents the workers. and there are no Laws that prohibits LGBTs to form an organization inside a company because LGBT rights are far from workers rights. With regards to schools I believe that it is within the prerogative of the schools if they will allow it or not. Because there are schools that don't allow political organization because it is one of there teachings specially in christian schools. Schools are for learning things and not about political activities.
f) denying a person access to public or private medical and other health services open to general public on the basis of such person's sexual orientation, gender identity or expression.
There is no discrimination in medical institutions or medical health services just because you are an LGBT member. So why is it that there is a need to put it in the bill if discrimination is non existent?
g) Denying an application or for revoking a professional, or other similar kind of license, clearance, certification on, or any other similar document,except marriage license, issued by government due to the applicants sexual orientation or gender identity or expression.
Government, being a servant of the people, does not deny any person about applying for licenses. there are no laws discriminating LGBT's. But it is totally different if you want to change your name in the birth certificate.
h) Denying a person access to or the use of establishments, facilities, utilities or services including housing, open to the general public on the basis of sexual orientation or gender identity or expression. provided that the act of of giving inferior accommodations or services shall be considered a denial of access or such facility or service: provided further, that this prohibition covers acts of discrimination juridical persons solely on the basis of the sexual orientation or gender identity or expression of their members or, of their target constituencies;
This is another snowflake paragraph in this bill, business establishment has the right to put there own set of guidelines because it is there property. If you think that you are discriminated then you can warn other people or launch a boycott in the particular establishment. But of course we will go back to the basics of Capitalists and that is money, if they fill that they are loosing money because of there own policy they are willing to change it in order for them to stay in business.
i) Subjecting or forcing any person to undertake any medical or psychological examination to determine or alter, or both, the person's sexual orientation, gender identity or expression without the expressed approval of the person involved, except in cases where the person involved is a minor or below the age of discernment in which case prior approval of the appropriate family code shall be required. in the latter case, the child shall be represented in the proceedings by the sol gen or the latter authorized representative
Today there is no policy of any company that you should have a medical exam solely because you are an LGBT. The only medical exam that the company needed are the anual physical exam required by DOLE. Some people might say that companies can single out LGBTs because they are prone to STD's so that they can fire them well they can't because we are already protected by the law on discrimination against people who have STDs. Under Republic act. 11166 or the An Act Strengthening the Philippine Comprehensive Policy on Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) Prevention, Treatment, Care, and Support, and, Reconstituting the Philippine National Aids Council (PNAC),
j) Harassment, coercion, or threats committed by institutions in the enforcement of and the protection of rights of any person on the basis of sexual orientation, gender identity or expression. Among other cases, or prohibited acts under this section, include, arresting or placing under custody and subjecting a person to extortion, physical, or verbal abuse, sexual abuse, regardless of whether such arrest has legal or factual basis, Harassment coercion, or threat, of juridical persons on the basis of sexual orientation, gender identity or expression.of their members, stockholders, benefactors, clients, or patrons is likewise covered by this provision.
For me the essence of this paragraph is already written in our current laws particularly the Revised penal code. And all of the paragraph from this bill were already written in the current laws of the land so there's no need to create a new one and as for the recognition of trans woman to be a real woman is not acceptable.
Why is it that it is not acceptable? first is because men are a lot stronger than women when it comes to physicality. In the United States transgender MMA fighter Fallon Fox broke the scull of his female opponent Tamika Brents. Imagine if all of transwoman join all the competition exclusively for woman, specially in martial arts then what will happen or even in the Ms. Universe and it can paved the way for a woman who has undergone with plastic surgery to join the competition and the whole essence of natural beauty will be lost. So are we going to wait for a woman to have a broken skull in order for us to be awaken that this sogie bill is dangerous? We must judge a policy not on its intentions but on the results.
